2 victims in 2 fatal DUIs

A special education teacher and a drugged driver received 7 years in prison for fatal DUIs.

According to 11th Circuit Solicitor Rick Hubbard, the two are Nicole Marie Wilson, 30, and Marshall Brandon McFarland, 37.

Both pled guilty to felony driving under the influence resulting in death.

Circuit Court Judge Eugene C. Griffith, Jr. sentenced them to 7 years each without parole.

Wyatt Duval, 21, of Lugoff, was traveling as a passenger in an Acura driven by McFarland on the eastbound lanes of I-20 in Lexington County Sept. 2, 2017.

McFarland unlawfully tried to pass another vehicle near the 60 mile marker in a construction zone. He lost control, causing the vehicle to overturn several times. Duval was ejected from the vehicle and died at the scene.

The Highway Patrol reported a blood sample from McFarland showed he was under the influence of methamphetamine and his blood alcohol content was .091. The legal limit is .08.

Wilson, a special education teacher at Rocky Creek Elementary School, faced a sentence of 1 to 25 years.

Wilson was driving a 2011 Hyundai Sonata on US-378 (Sunset Boulevard) when she ran a red light. She hit Roger Wayne Johnson’s vehicle at 11:11 p.m. Jan. 5, 2017.

Surveillance video showed Wilson never applied brakes.

Johnson, 75, had picked up his grandchild from work at Apple-bee’s in the Harbison area. Both had to be extricated from their Jeep Compass. Johnson was pronounced dead at Lexington Medical Center.

Lexington Police reported Wilson ordered 2 pints of beer at D’s Wings in Cayce about 6:30 p.m. A witness reported she consumed 2 beers during a kickball game. During a second game, a witness said, Wilson consumed 2 more beers then returned to D’s Wings about 10:15 p.m. and consumed an additional pint of beer.

A blood sample taken at 2:30 a.m. showed Wilson’s blood alcohol level was .20, more than twice the legal .08 limit.

She was taken to the Department of Corrections to begin serving her sentence.

Solicitors Todd Wagoner and Robby McNair prosecuted the cases.
