Gaston woman wins $284K in false arrest suit

A falsely accused woman has won $284,000 in a suit against the Lexington County Sheriff’s Department.

West Columbia attorney Jake Moore said the court awarded her $100,000 after she was falsely arrested for shoplifting at the Red Bank Walmart in 2014.

Sheriff’s department attorney David DeMasters said, “Everyone who is charged with a crime enjoys the presumption of innocence, which is why the shoplifting charge against Mrs. Jackson was immediately dropped by Deputy Wiseman in 2014 when the complaining witness did not appear to testify.

“We wish Mrs. Jackson the very best and hope that the decision puts the matter to rest for everyone.”

A sheriff’s department spokesman said:

• Walmart agreed to pay Jackson $84,000 in an out of court settlement.

• The jury awarded double damages of $200,000 which the state insurance fund is expected to appeal.

After Sabrina Jackson voluntarily turned herself in, she was left in a cell more than 12 hours before Deputy Darren Wiseman learned the wrong woman was arrested and dismissed charges against her, a sheriff’s department spokesman said.

In court filings, the department said Wiseman was acting in the course of his work as a deputy.

The case began when Ivan Dennis of the Red Bank Walmart saw a woman take items worth $50 and leave without paying.

Dennis noted the make, model and license plate number of the vehicle.

This led Wiseman to a woman who told him her friend Sabrina Jackson was with her that day.

Wiseman showed the woman the screen shot of the alleged thief and she said she recognized her friend who was moving or had moved to Charlotte.

Wiseman found a Department of Motor Vehicle record for Sabrina Jackson with a photo and address to a home near Gaston.

The suit claims the photo shows different women.
