Gilbert mobile vending now limited to benefit public, town says

The Town of Gilbert has set new rules for mobile vendors.

Mobile Vendors can only be set up in General Commercial and Institutional Districts.

A mobile vendor is a person, corporation or business entity who vends and sells food products, merchandise and drinks.

Before starting, mobile vendors must get a permit from the Town of Gilbert Clerk. They need to provide:

  • Written approval from property owner or agent where they’ll set up.
  • Tax IDs from the federal and state government.
  • Proof of insurance.
  • Approval from the Department of Environmental Control if selling food.
  • A list of items they plan to sell (food, drinks, excluding alcohol and merchandise).
  • Once approved, the list of items must be posted on the mobile unit.
  • The town clerk has the right to reduce the issuance of license/permit.

Other limitations:

  • One license per vendor and it can’t be transferred to someone else.
  • A copy of the license must always be with the operator.
  • The annual fee for a mobile vendor license is $100.
  • Limits on the number of vendors: (2) per ¼ acre, (3) per ½ acre and (6) per 1 acre.
  • Vendors can’t sell counterfeit goods, alcohol, drugs, fireworks, tobacco or adult materials.
  • Vendors can’t block emergency access or sidewalk.
  • Vendors must have utility hookups from the property they are located on.
  • Fire extinguisher must be on site.
  • Vendors violating the rules will be asked to leave and will not be allowed to renew their license.

However, to support the Lexington County Peach Festival, the Town of Gilbert will allow it to preform without a license.

Nonprofits such as school/clubs and churches do not need a business license to operate.

 Permitted operating hours:

  • Sunday to Thursday: 8 a.m. to 9 p.m.
  • Friday and Saturday: 8 a.m. to 11 p.m.

"Reasonal regulations of Mobile Vendors is necessary to protect the public health, safety, morals and general welfare of the Town of Gilbert," according to public documents detailing the ordinance.
