Former Chapin Football Standout Again Investigated for Criminal Sexual Conduct With Minor

For the second time in six months, the same former Chapin High School football standout is under investigation for criminal sexual conduct with a minor.

The state Law Enforcement Division announced Monday that it has taken over a case regarding allegations made against David Bennett Galloway III.

"SLED was requested by the Newberry County Sheriff’s Office to investigate an allegation of criminal sexual conduct by David Bennett Galloway, III," said Renee Wunderlich, Director of Public Information of SLED, in a statement. "No other information is available at this time as agents continue to investigate."

Newberry County Sheriff Lee Foster confirmed the incident reportedly took place April 28 in his jurisdiction. Foster said the victim was a minor who is a relative of a sheriff's department employee. 

Turning over a case involving an employee or their family is standard procedure for the department,  Fostersaid. 

The sheriff also said if criminal actions are determined, SLED could possibly turn it over to the Eighth Circuit Solicitor's Office or the state Attorney General. 

Back in January, Galloway was initially charged in Richland County with second-degree criminal sexual conduct in connection with an Oct. 2 incident with a minor in Irmo.

After a plea agreement with the Fifth Circuit Solicitor's Office, Galloway admitted in court to “unlawful touching” of the girl. He pleaded guilty to third-degree assault and received a suspended sentence of 60 days and 240 hours of community service.

Former attorney Jim May said a lie detector test showed Galloway to be truthful in stating he did not know the age of the girl. The solicitor’s office acknowledged in court the evidence didn’t rise to second-degree criminal sexual conduct with a minor, resulting in the lesser charges.

Galloway was also ordered to pay $15,000 in restitution to the victim for counseling. He was scheduled to complete his senior year at Chapin High School and had received a scholarship offer from North Carolina State. 

A spokesperson for Lexington-Richland School District 5 confirmed Monday that Galloway is no longer a student at Chapin High School.  

Galloway was a senior entering the school year and football season. He played in all but the final game of the season, a playoff loss that took place while he was placed on overnight house arrest. Prior to the arrest, Galloway received an offer to play football at N.C. State.
