SC Electric & Gas lost twice in court last week.
Its second loss was to construction workers at its failed nuclear project.
The company is accused of not giving enough notice before calling off work on the site, leaving 5,000 workers in the lurch.
The lawsuit seeks extra pay for those who under federal law are generally entitled to two months’ notice of mass layoffs.
SCE&G says it isn’t responsible for giving notice because its contractors employed the workers.
U.S. District Judge J. Michelle Childs ruled SCE&G appeared to have control of its contractors’ crews.
