Special prosecutor David Pascoe wants to undo a plea deal he agreed to.
Pascoe said he was “blindsided” when he agreed to no prison time in the corruption trial of former Lexington lawmaker Rick Quinn.
Pascoe told SC Supreme Court justices last week that Judge Carmen Mullen let Quinn plead guilty to a narrower charge Pascoe called a non-crime to avoid prison.
Pascoe said a state grand jury indicted Quinn on a broad pattern of misconduct involving millions of dollars Quinn illegally took.
It may be months before justices issue an opinion, reporter John Monk wrote in The State newspaper.
The justices could:
• Nullify Quinn’s deal.
• Send his case back to another trial court.
• Have him resentenced.
• Take Judge Mullen off the case or keep her.
• Let Quinn’s conviction and sentence stand but make clear he was convicted of misconduct in office.
