The Public Service Commission takes the prize for stupidity. They decided to allow Carolina Water to increase their rates to recoup their legal fees for defending themselves for violating the Clean Water Act.

They were found guilty.

Is Carolina Water or its customers being punished for wrong doing when they can pass their legal fees on to us?

Of course, they still have to pay the fine for polluting, but this is small compared to the $1 million in legal fees they incurred trying to defend themselves of a dirty deed.

The PSC said Carolina Water did not have a choice as they had to defend themselves. Really?

They chose between polluting the lower Saluda River with untreated sewage and NOT polluting. They chose to pollute.

If punishment for polluting including fines and legal fees are passed on to the customers, what incentive is there for Carolina Water to do the right thing in the future?
