State challenges city on guns

SC’s Attorney General is suing the City of Columbia over its gun laws.

Attorney General Alan Wilson says these 3 gun ordinances violate state law and the 2nd Amendment:

1. Allowing the city to take weapons from people with Extreme Risk Protection Orders against them

2. Banning firearms within 1,000 feet of a school

3. Prohibiting homemade firearms also known as ghost guns.

Wilson sent Columbia Mayor Steve Benjamin a letter on Dec. 3, 2019, addressing this and asking that the ordinances be repealed.

Benjamin said earlier he did not agree but has not yet responded to the suit.

“We have consistently advised for almost 3 decades that state law preempts local regulation of firearms. These ordinances clearly violate the state law that prohibits local governments from passing any gun laws or ordinances that regulate the transfer, ownership, or possession of firearms,” Wilson said.

Gun ownership and use has become an issue between anti-gun Democrats and pro-2nd Amendment Republicans in this year’s Presidential election campaign.

The Chronicle asked if Attorney General Wilson would support similar legislation be made to South Carolina gun laws.

His office responded that they will not comment outside of their official press release during pending legislation.

“Attorney General Wilson will be happy to discuss this case and answer any of your questions after the court has made a final ruling,” the AG office said.
